How Marbella agencies are structured

Most Marbella agencies share listings through MLS networks (Resales Online, LPA, Marbella MLS), which means several agencies can legitimately show you the same property. What differs is who holds the direct mandate from the seller. The direct listing agency knows the seller's real motivation, their flexibility on price and their timing — the sharing agency does not. Above €3M, direct mandates are concentrated in a small number of houses.

Nueva Andalucía and golf valley specialists carry the deepest golf-side inventory. Below €700K, strong local independents in San Pedro, Elviria and Nueva Andalucía hold better stock than the international brands.

How commission works and who pays it

In Spain the seller pays the commission, typically 3–5% plus IVA on the Costa del Sol, and it is split when two agencies share the deal. As a buyer this means agency advice is not free of interest — the agent is paid by the other side. That is precisely why an independent lawyer is not optional, and why a genuine buyer's agent (paid by you, on a fixed fee or a percentage) can pay for itself above €2M.

Six questions that separate the good from the rest

Do you hold the direct mandate on this property, or is it shared? How long has it been on the market and has the asking price moved? Why is the seller selling, and what is their timing? What is the community's reserve fund and is any derrama planned? What did the last three comparable sales on this street actually achieve? And: what would make you advise me not to buy this? An agent who cannot answer the last one is selling brochures.
